Introduction to Terms & Conditions

These terms and conditions, which may be modified from time to time, apply to all our services, either directly or indirectly (via distributors), available online, through any mobile device, via email, or over the phone. By accessing, browsing, and using our website or any of our applications on any platform, or by completing a reservation, you acknowledge and agree to these terms and conditions, including the privacy statement.

Definitions

“Dubai Boat Charter,” “us,” “we,” or “our” refers to Dubai Boat Charter, a limited liability company established under the United Arab Emirates laws, with its registered office at Al WDAA Business Center, Raga Al Buteen – DUBAI, the United Arab Emirates. The “Platform” refers to the website and app where the Trip Service, owned, controlled, managed, maintained, or hosted by Dubai Boat Charter, is available. A “Trip” refers to the various services and activities that you can order, acquire, purchase, pay for, rent, reserve, or consume from the Trip Provider.

“Trip Service” refers to the online purchase, order, payment, or reservation service as offered or enabled by Dubai Boat Charter for various products and services made available by Trip Providers on the Platform.

“Trip Reservation” refers to the order, purchase, payment, booking, or reservation of a Trip.

Accepted Payment

We accept online payments through several methods, including Visa and MasterCard (credit/debit cards), and other options in AED.

Credit Card or Bank Transfer

Where applicable and available, we provide the option for Trip Reservations to be paid to the Trip Provider during the Trip Reservation process through secure online payment (to the extent offered and supported by your bank). For certain products and services, Dubai Boat Charter facilitates the payment of the relevant product or service (i.e., the payment facilitation service) for and on behalf of the Trip Provider through third-party payment processors. Payments are securely processed from your credit/debit card or bank account.

Please note that certain (non-refundable) rates or special offers may require payment upfront by wire transfer (if available) or by credit card, and therefore your credit card may be pre-authorized or charged upon making the Trip Reservation. Check the details of your chosen product or service thoroughly for any such conditions before making your Trip Reservation. You agree not to hold Dubai Boat Charter liable for any (authorized, unauthorized, or incorrect) charge and not reclaim any amount for any valid or authorized charges.

In case of credit card fraud or unauthorized use of your credit card by third parties, immediately contact us via email at info@dubaiboatcharter.com and state ‘credit card fraud’ in the subject line. Please provide evidence of the charged deductible. This indemnification applies only to credit card reservations made using Dubai Boat Charter’s secure server and the unauthorized use of your credit card resulted through our default or negligence, not through any fault of your own while using the secure server.

Prepayment, Cancellation, and No-Show Policy

Please remember, for certain rates or special offers that require prepayment, your credit card may be pre-authorized or charged upon making the Trip Reservation. Therefore, please check the reservation details of your chosen product or service thoroughly for such conditions before finalizing your Trip Reservation.

If you encounter issues with unauthorized charges, especially in the case of credit card fraud or unauthorized use of your credit card by third parties, immediately contact us via email at dubaiboatcharter@gmail.com. Make sure to include ‘credit card fraud’ in the subject line of your email and provide us with evidence of the charged deductible (e.g. policy of the credit card company).

This indemnification only applies to credit card reservations made using Dubai Boat Charter’s secure server. If the unauthorized use of your credit card resulted due to our default or negligence and through no fault of your own while using the secure server, Dubai Boat Charter will bear the responsibility. However, for valid or authorized charges (including prepaid rates, no-show, and chargeable cancellation), you agree not to hold Dubai Boat Charter liable or responsible.

We understand the importance of safeguarding your personal transactions and ensuring an enjoyable and worry-free booking experience. With Dubai Boat Charter, explore Dubai in its full grandeur aboard our luxurious yachts and cherish unforgettable moments.

Communication and Correspondence

Upon making a booking with Dubai Boat Charter, you consent to the following communication protocol:

  1. Pre-Arrival Email: We may send you an email before your trip begins. This email will contain information about your destination and various offers (including third-party ones, provided you have opted for such updates) that are relevant to your booking and destination.

  2. Post-Experience Evaluation: After your trip, we will send an email requesting your feedback on your experience with Dubai Boat Charter.

  3. Guest Review Invitation: After your stay, we may send you an email inviting you to complete our guest review form. For more details on how we may contact you, please refer to our privacy and cookies policy.

To successfully complete and secure your booking, it is crucial to provide your correct email address. Dubai Boat Charter is not responsible or liable for any errors in email addresses, mobile phone numbers, or credit card numbers.

Claims and Complaints

Any complaints or claims against Dubai Boat Charter, or regarding our services, must be submitted promptly, within 30 days after the conclusion of the service (e.g., end of trip). Claims or complaints made after 30 days may be rejected, and the claimant forfeits the right to any compensation. Given the frequent updates and adjustments of rates and availability, we recommend taking screenshots during the booking process for future reference, if necessary.

Customer Reviews

Dubai Boat Charter will not tolerate reviews containing:

  • Profanity, sexually explicit language, hate speech, discrimination, threats, or violence.
  • Full names or personal attacks towards staff.
  • Promotion of illegal activities.
  • Site links, email addresses, phone numbers, credit card details.
  • Politically sensitive comments.

Intellectual Property Rights

Unless otherwise mentioned, the software necessary for our services, available at or used by our platform, and the intellectual property rights of the contents and information on our platform belong to Dubai Boat Charter.

Dubai Boat Charter retains exclusive ownership of all rights, including intellectual property rights, of the platform where the service is provided (including guest reviews and translated content). Unauthorized copying, publishing, promoting, marketing, integrating, using, or combining of our content, including translations and guest reviews, without express written permission from us is strictly prohibited. If you use or combine our content or if you acquire any intellectual property rights on the platform, translated content, or guest reviews, you agree to transfer all such rights to Dubai Boat Charter. Any unlawful use or infringement will be considered a violation of our intellectual property rights, including copyright and database right.

Applicable Laws and Jurisdiction

The services and products provided by Dubai Boat Charter, along with these terms and conditions, are governed and interpreted according to the laws of the United Arab Emirates (UAE). Any disputes or claims related to this website will also be settled in accordance with UAE laws. The UAE is our country of domicile.

Customers under the age of 18 are prohibited from registering as users and transacting or using the website. When you make a payment for our products or services on our website, your details are submitted directly to our payment provider through a secured connection. As a cardholder, you should retain a copy of your transaction records as well as our policies and rules.

Dubai Boat Charter will NOT provide services or products to any countries under OFAC sanctions as per UAE law.

Terms and Conditions for Trips & Bookings

Prior to starting, clients should thoroughly understand the terms and conditions. The timing of trips and availability is subject to weather conditions and may vary. Completion of payment does not automatically confirm your booking.

Upon successful payment, customers will receive an email confirming the payment’s success and the commencement of booking processing from our end. A confirmation email with complete order details, contacts, and booking location will be sent within 15 minutes of payment completion.

If the selected vessel is unavailable, customers will be offered the choice of an alternative or a full refund. Rental agreements must be paid in advance.

Guidelines for Guests

All guests are required to present an original Emirates ID or Passport – copies or pictures are not accepted. This includes all passengers, including children and infants. All guests must adhere to the captain’s instructions and not offend staff members; any violation could result in trip cancellation without any compensation.

Should a guest sustain an injury due to failure to follow instructions, the company will not be liable for compensation. Customers are expected to comply with Marina’s speed limit and control their music volume. Any violation will result in financial penalties that will be borne by the client.

Safety and Compliance

Guests are required to wear life jackets throughout the trip, except if they remain inside the boat or yacht. Non-compliance can result in fines from the coast guard or police, for which the customer will be held fully responsible. According to UAE Registration and Insurance Law, infants (one month old) are also counted as persons.

Guests must nominate a group leader before departure, who will be authorized to coordinate all onboard activities with the captain’s consent and sign this document on their behalf. Movement on board should be done cautiously; the captain or company will not be responsible for any mishaps.

Parents or guardians are responsible for their children’s safety. The captain’s approval must be obtained before entering the water. If any guest consumes alcohol or abuses substances, the yacht or boat will return to the marina, and the amount paid will not be refunded.

Restrictions and Prohibitions

Carrying any kind of drugs on board the yachts, boats, or water sports equipment is strictly prohibited. Non-swimmers, senior citizens, and expecting mothers should exercise extreme caution. Any misbehavior by clients can lead to the vessel or water sports equipment heading directly to the police, coast guard, or our marina with no refund for the cost.

Parents or guardians should be highly vigilant for the safety and security of their children or dependents. Passengers or guests should check their belongings before leaving the yacht, boat, or water sports equipment as the Captain or the Company assumes no liability for the loss of property after departure.

Any damage to the vessel or water sports equipment caused by the customer will be their full responsibility, and payment will be made on the spot or via any subsequent arrangement.

Technical Failures and Age Restrictions

In case of any technical or mechanical failure during the trip, the yacht, boat, or water sports equipment will return to the site and the trip will be halted for safety reasons. A partial refund may be possible, or alternative arrangements like rescheduling the trip will be discussed.

It is the guest’s responsibility to inform the captain about any other pertinent information not mentioned in the document. Water sports and jet ski rides are only permitted for individuals above 16 years and under 60 years old. Seniors and pregnant women from six months and up are not allowed to drive or ride water sports.

Liability and Responsibilities

The lessee will be personally accountable for the consequences of an accident with water sports equipment. Any damage to the water sports equipment made by the client will be charged to the client, including the cost of repair. This payment will be due immediately or through subsequent arrangements.

Each customer is entirely responsible for their equipment. If the customer enters a restricted area and the equipment is seized by the authorities, the customer will be liable for the full price of the equipment and any resulting financial or legal liabilities.

Customers should not drive water sports equipment near the beach or in water less than half a meter deep. This is to avoid blocking the water discharge outlet. If this instruction is not followed, the customer agrees to pay the cost of damages resulting from this.

Mandatory Rules and Policies

Life jackets must be worn during the trip (only applicable for water sports). The use of alcohol is strictly forbidden during Ramadan and dry days as per the law. The captain should be informed in writing about non-swimmers and expecting mothers before setting out to sea.

Guests are not permitted to jump into the sea or water when the vessel or water sports equipment is moving. Littering overboard is strictly prohibited.

The customer must arrive at the trip site 15 minutes before the start of the trip to maintain scheduling. The company is not responsible for any delays on the part of the client, and there will be no refund for time lost.

Bringing any pets or animals aboard is strictly prohibited.

  1. Rental agreement to be paid in advance.
  2. All guests should bring an original Emirates ID or original Passport. not a copy or picture. please all people and all children Even babies.
  3. Customers must follow the captain’s instructions and not offend employees, resulting in the cancellation of the trip and no compensation for the customers.
  4. The company is not responsible for compensating the client in case of injury, where the injury results from failure to follow the instructions.
  5. Customer commitment to Marina’s speed limit, with the reduction of music, where the violation results in a financial violation borne by the client.
  6. Refunds will only be allowed in case of bad weather or non-availability of services at the date and time of booking.
  7. All guests should wear life jackets all the time during the trip. If you will stay inside the boat or yacht no need to wear it. if don’t follow that which will result in coast guard/police fines. it will carry on the customer/client’s full responsibility.
  8. According to UAE Registration and Insurance Law. Infant children (one month old) are considered/counted as a person.
  9. Person must nominate a person as head of the group before the vessel leaving the berth, which will be authorized to coordinate all activities on board by consent of the captain and sign this document on their behalf.
  10. Movement on board should be carried out with extreme caution, the captain/company will not be held responsible.
  11. Parents/guards are responsible for the safety of their children / loved ones.
  12. The captain’s approval must be obtained before entering the water.
  13. If any guest drinks alcohol/abuse, the yacht/boat will return to the marina and the amount paid will not be refunded.
  14. It is strictly forbidden to carry any kind of drugs on board the yachts/boats/water sports.
  15. Non-swimmers, senior citizens, and expected mothers should take care with extreme caution.
  16. If any of the customers/clients will be misbehaving, the vessel or water sports equipment will be heading directly to the police /coast guard or on our marina. No refund for the full cost.
  17. Parents/ guardians should take extreme caution for the safety and security of their children/dependents.
  18. Passengers/guests must check their property before leaving the yacht – boat – water sports. The Captain – Company assumes no liability for the loss of property after the yacht – boat- water sports departure.
  19. Jumping to another vessel is strictly prohibited.
  20. Any kind of loss /damage to the vessel or water sports Equipment made by the customer /client will be their full responsibility. Payment will be done on the spot or any arrangement thereafter.
  21. For any unwanted technical/mechanical failure during the trip, the yacht or boat, or water sports equipment must go back to the site and the trip will be stopped due to safety reasons. A partial refund will be possible or alternative arrangements will be discussed such as rescheduling of the trip.
  22. It is the responsibility of the guest to inform the captain about any other information not mentioned in the document written thereafter.
  23. the allowed ages on water sports and jet ski rides only are above 16 years and under 60 years old.
  24. Seniors and pregnant women from 6 months till up are not allowed to drive/ride water sports.
  25. the lessee will be personally responsible for the consequences of the accident with the water sports.
  26. any kind of loss/ damage to the water sports made by the client will be recovered from the client. The cost will be inclusive of the service of the repair. payment will be on the spot or any arrangements thereafter.
  27. each customer is fully responsible for his equipment before the company whether being answerable for the accident by himself or otherwise.
  28. If the tenant entered the restricted area and the equipment was possessed by the authority, the tenant should be liable for the full price of the equipment and any financial or legal liabilities arising because of this action.
  29. The customer shall not drive water sports near to the beach or in water less than ½ meter deep to avoid closing of the water discharged outlet, otherwise, the customer undertakes to pay the cost of damages resulting therefrom.
  30. Not wearing a life jacket = no trip (water sport only).
  31. Alcohol is strictly not allowed during Ramadan and dry days as per law.
  32. Head must inform in written the captain about non-swimmers and expecting mother before going to the sea.
  33. No guest is permitted to jump into sea/water when the vessel or water sports equipment is underway or moving.
  34. Throwing any kind of garbage overboard is strictly prohibited.
  35. The customer must be on the trip site 15 minutes before the start of the trip to maintain his time and time of others after him, as the company does not bear the delay of the client about the time of his trip. There is no option to recover money.
  36. No animals or pets of any kind can be taken aboard.
